Terms of Service

These Terms of Service ("Terms") govern your use of the payment services provided by Qpay ("Qpay", "we", "us"). By creating an account or using the Services you agree to these Terms.

1. The Services

Qpay provides a hosted checkout, APIs and tools that let merchants accept payments through bKash and other mobile financial services, either through our platform accounts ("Platform gateway") or through the merchant's own accounts ("Own accounts").

2. Eligibility and account

  • You must be at least 18 years old and able to enter into a binding contract, and you must run a lawful business.
  • You must provide accurate information and keep it up to date. We may ask for business verification documents and may limit or refuse service until verification is complete.
  • You are responsible for all activity under your account, including your team members and API keys. Keep your credentials secret and tell us immediately about any unauthorised use.

3. Prohibited use

You may not use the Services for illegal goods or services, gambling, fraud, money laundering, pyramid schemes, adult content, counterfeit goods, or anything that violates the rules of bKash, other payment providers or Bangladeshi law. We may suspend accounts involved in prohibited activity and report it to the authorities.

4. Fees

  • Platform gateway payments are subject to the transaction charge of your pricing plan, shown in your panel and on our pricing page. You may choose to pass the charge on to your customer where allowed.
  • Monthly plan fees, instant settlement fees and settlement charges apply as shown at the time of the transaction.
  • Payments through your own accounts carry no transaction charge, but plan fees may apply.
  • We may change fees with prior notice in the merchant panel or by email.

5. Settlements

  • Platform gateway funds are credited to your balance after deducting charges. You can request a settlement to your chosen account at any time above the minimum amount.
  • Recent payments may be held for a short period, and large or unusual settlements may be reviewed for security. We may delay or withhold settlement where fraud, disputes, chargebacks or legal requirements apply.
  • You are responsible for providing correct payout details.

6. Refunds and disputes

  • Refunds are made from your balance or through your own account, as applicable. Charges for refunded payments may not be returned.
  • When a customer opens a dispute you must respond promptly with evidence. If a dispute is resolved in the customer's favour, the amount may be debited from your balance.

7. Your obligations to customers

You are responsible for the goods and services you sell, your prices, delivery, customer support and your own refund policy, and for complying with consumer protection and tax laws.

8. Availability

We aim for high availability but do not guarantee uninterrupted service. Payment providers, networks and maintenance can cause delays. Live status is published at https://pay.qpay.bd/status.

9. Liability

To the extent permitted by law, we are not liable for indirect or consequential losses, lost profits or losses caused by payment providers, your systems or third parties. Our total liability for any claim is limited to the fees you paid us in the three months before the claim.

10. Suspension and termination

You may close your account at any time after settling your balance. We may suspend or terminate accounts that breach these Terms, pose a risk, or where required by law or by our payment partners. Balances owed to you will be settled after any holds, refunds and disputes are resolved.

11. Changes

We may update these Terms. Continued use of the Services after changes take effect means you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of Bangladesh. Disputes are subject to the jurisdiction of the courts of Dhaka.
